Woman freed from credit card debt over PPI sale

A woman has been freed from an £8,000 credit card debt following a court ruling.

MBNA had sought repayment from Lynne Thorius, although a judge decided this was unfair because of the way she had been sold payment protection insurance.

Jacqueline Smart ruled that MBNA had not provided the appropriate documents to the customer, failing to inform her of regular commission payments to be made to the firm by ITT London & Edinburgh.

She declared that this secret commission agreement rendered the credit card deal unfair.

However, an MBNA spokesperson told the BBC that the case did not set a legal precedent.

"The case is a county court case and each case is decided on its own merits and on the factual circumstances of each case," Ms Smart.

Earlier this week, the Financial Services Authority announced plans to introduce extra protections for consumers in the payment protection insurance market.ADNFCR-2088-ID-19388154-ADNFCR
